Another reason to fire this board? All but Marcarian voted to hire a General Counsel (attorney on demand). Worse than that, this inexperienced board hired one unqualified under our CC&Rs.

Attorneys are like surgeons: You hire one when you need one. In my 33 years working in law, I have seen many attorneys "fear" inexperienced people into believing you need them. In my opinion, and as an insider, I can say with certainty that this has been driven by Seabreeze who fears they will be fired if this board is removed.

What is worse? Under the CC&Rs, specifically 5.3 (b)(1)(i), there is a requirement that the attorney meet the minimum standards of a Martindale-Hubbell rating of "AV" widely recognized as a mark of professional standards and ethical standards in the legal field. The founding members of our HOA required this to ensure only the highest quality legal advice would influence our development. Unfortunately.......

To provide an example of an attorney with the proper requirements:

Qualified and meets all requirements of our CC&Rs.

Let's take a look at Mr. Boyack's rating.

Mr. Boyack is not qualified to meet all requirements of our CC&Rs.

Worse than that? There is only one review of his work and the individual was in the exact same situation as the Homeowners.

Boyack appears to go rogue and refuses to accept the results of the election.

Conclusion? The board lacks the experience to even pick a quality attorney to protect themselves against you. There is a recall election at present. You can see from the review above what to expect, if Mr. Boyack is not removed from our payroll.
